Terms & Conditions

This document is an electronic record in terms of the Information Technology Act, 2000, and rules thereunder as applicable, including amended provisions relating to electronic records. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name www.nabhived.com (“Website”), including the related mobile site and mobile application (hereinafter referred to as the “Platform”).

The Platform is owned and operated by Kathak Ventures, a sole proprietorship, having its registered office at No.3, Bains Compound, Nanthencode, Trivandrum - 695003, Kerala (hereinafter referred to as "Platform Owner", “we”, “us”, or “our”).

Your use of the Platform, services, and tools are governed by the following Terms and Conditions ("Terms of Use"), including applicable policies incorporated herein by reference. By using the Platform, you agree to be bound by these Terms.

1. User Agreement

By accessing, browsing, or using the Platform, you agree to comply with and be bound by these Terms of Use. If you do not agree, please do not use the Platform.

2. Services Overview

The Platform is an e-commerce website offering products for sale. Orders placed on the Platform are subject to acceptance and availability.

3. Accuracy of Information

You agree to provide true, accurate, and complete information during registration or purchase. You are responsible for all activities conducted through your account.

4. Product Information

We strive to ensure accuracy in product descriptions, pricing, and images. However:

  • Minor variations may occur
  • Colors may differ due to screen settings
  • We do not guarantee completeness or error-free listings

5. Pricing & Payments

  • All prices are listed in INR
  • We reserve the right to change prices without notice
  • Payments must be completed before order processing (except Cash on Delivery orders)

6. Shipping & Delivery

  • Orders are processed within 2–5 business days
  • Delivery timelines depend on courier partners and location
  • Delays caused by logistics providers are beyond our control
  • Delivery is deemed complete when the product is delivered to the address provided

7. Returns & Refunds

We offer returns/replacements under the following conditions:

  • Product must be defective, damaged, or incorrect
  • Request must be raised within 48 hours of delivery
  • Proof (photos/videos) may be required

Non-returnable cases:

  • Used products
  • Minor variations in appearance
  • Customer preference changes

Refunds (if approved):

  • Processed within 5–7 business days
  • Credited to original payment method or as store credit

8. Cash on Delivery (COD) Policy

  • COD is available for selected locations
  • We reserve the right to confirm orders before dispatch
  • Fake or unverified COD orders may be cancelled

9. No Warranty

All products and services are provided "as is" without warranties of any kind, either express or implied.

10. Limitation of Liability

The Platform Owner shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits, data, or business
  • Any delay or failure beyond our control

Maximum liability shall not exceed:
the amount paid by the user or ₹100, whichever is lower

11. Intellectual Property

All content on the Platform (design, text, images, graphics) is owned or licensed by us. Unauthorized use is strictly prohibited.

12. Prohibited Use

You agree not to:

  • Use the Platform for unlawful purposes
  • Provide false information
  • Attempt to harm or disrupt the Platform

13. Third-Party Links

The Platform may contain links to external websites. We are not responsible for their content or policies.

14. Indemnity

You agree to indemnify and hold harmless the Platform Owner from any claims arising due to:

  • Breach of these Terms
  • Violation of any law or third-party rights

15. Force Majeure

We are not liable for delays or failure due to events beyond our control, including natural disasters, strikes, or government restrictions.

16. Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.
All disputes shall be subject to the exclusive jurisdiction of the courts in Thiruvananthapuram, Kerala.

17. Modifications

We reserve the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.
